What is the Vaccine Injury Compensation Program?

Most people never expect a routine vaccination to cause harm. But when it does, the Vaccine Injury Compensation Program (VICP) is often the only way to secure financial recovery. This federal program was created to provide compensation for people harmed by certain vaccines — without suing doctors, clinics, or manufacturers directly. Instead, claims are heard in the U.S. Court of Federal Claims, where special judges called Special Masters decide these cases.

Why Choose Battle Law for Your Vaccine Case?

  • Admitted to the Vaccine Court: Attorney R. Lee Page is one of the few lawyers admitted to practice before the U.S. Court of Federal Claims and its Special Masters.
  • Nationwide representation: We represent vaccine-injured clients across the country.
  • No cost to you: Attorneys’ fees are paid through the program, not from your award.
  • Personalized guidance: We help gather records, work with experts, and simplify the process so you can focus on recovery.
Which Vaccines Are Covered?

Not all vaccines are covered. VICP applies to those listed on the Vaccine Injury Table.

Common examples include:

  • Flu shots (seasonal influenza)
  • MMR (measles, mumps, rubella)
  • Tdap / DTaP (diphtheria, tetanus, pertussis)
  • Polio (IPV)
  • Varicella (chickenpox)
  • Hepatitis A & B
  • HPV (Gardasil, Cervarix)
  • Meningococcal vaccines
  • Pneumococcal vaccines

Currently, COVID-19 vaccine injuries are handled in a separate program called CICP, though future legislation could bring them into VICP.

Common Vaccine Injuries (Including SIRVA / SRIVA)

Some of the most frequently compensated vaccine injuries include:

  • SIRVA (Shoulder Injury Related to Vaccine Administration) — often misheard as “SRIVA”
  • Severe allergic reactions (anaphylaxis)
  • Guillain-Barré Syndrome (GBS)
  • Brain inflammation (encephalitis/encephalopathy)
  • Chronic arthritis (after rubella vaccination)
  • Syncope (fainting) injuries

VICP recognizes both “Table injuries” (listed injuries with specific timeframes) and “off-table injuries” (not listed, but proven through medical evidence and expert testimony).

What Compensation Is Available?

If your claim is approved, VICP may provide:

  • Coverage of medical treatment and future care needs
  • Lost wages or reduced future earnings
  • Pain and suffering, up to $250,000
  • Attorneys’ fees and costs, paid by the program—not out of your recovery

Unlike typical lawsuits, you do not pay contingency fees.

Deadlines to File

The law sets strict deadlines:

  • Injury cases: must be filed within 3 years of the first symptom
  • Death cases: must be filed within 2 years of death and within 4 years of the first
    symptom

If these deadlines are missed, you lose the right to file. Acting quickly is critical.

The Vaccine Case Process
  1. Petition filed in the U.S. Court of Federal Claims
  2. Medical review by federal health officials
  3. Government response by DOJ lawyers
  4. Hearing or ruling before a Special Master
  5. Decision issued — compensation granted or denied
  6. Payment of damages and attorneys’ fees
  7. Appeals, if necessary, to higher federal courts

Cases can take time, but with the right legal support, families have a strong chance of success.

Frequently Asked Questions
  • Do I need to prove the vaccine caused my injury? If your condition is a listed "Table injury" and symptoms started within the timeframe, it’s presumed to be vaccine-related. Otherwise, you’ll need medical proof, which we help build with experts.
  • Is this a lawsuit against my doctor or clinic? No. This is a claim against the federal program. Your health care provider is not sued.
  • Can I handle this on my own? Technically yes, but the process is complicated. Most successful cases are handled by attorneys admitted to practice in the Vaccine Court.
  • What if my claim is denied? You can appeal through the U.S. Court of Federal Claims, the Federal Circuit, and ultimately the U.S. Supreme Court if necessary.
